Terms and Conditions

Last updated: 21 September 2026

1. About us

The website www.landofthehummingbird.com (the “Website”) is operated by Rachel Lee Young (Trinidad), a creative sole trader based in Diego Martin, Trinidad and Tobago. “Rachel Lee Young’, “Rachel Lee Young (Trinidad)”, ”Rachel”, “Land of the Hummingbird”, “we”, “us” and “our” refer to the business operating the Website.

You can contact us at rachel@landofthehummingbird.com or by WhatsApp or telephone at +1 868 682 4063. Studio visits and order collection are available only by prior arrangement; collection details are provided after an appointment is confirmed.

2. Acceptance of these Terms

By using the Website or placing an order, you agree to these Terms and the policies referred to in them. If you do not agree, please do not use the Website or submit an order.

You must be at least 18 years old, or have the involvement and consent of a parent or legal guardian, to place an order. If you place an order for another person, you are responsible for providing accurate delivery information and for ensuring that the recipient can accept the parcel.

3. Our products

Our collections are developed from Rachel Lee Young’s original photography of Trinidad and Tobago and include homeware, accessories, gifts, jewellery and fine-art prints. Products may be locally made, locally finished, produced with specialist partners, imported, or assembled using more than one production method.

Items are produced in small batches, and selected pieces are made to order. Availability may therefore change quickly. If an ordered item is unavailable, we will contact you and if required,  offer an appropriate alternative or a full refund for that item.

We take reasonable care to describe and photograph products accurately. Colours can vary between screens, and small differences in print placement, stitching, texture, dimensions or finish are natural in small-batch and handmade production. These minor variations are not faults, but nothing in this paragraph limits your rights if an item is materially misdescribed, defective or unfit for its stated purpose.

4. Prices, currency and taxes

Prices and the currency to be charged will be shown before you submit an order. Prices are shown in Trinidad and Tobago dollars (TT$) unless you select US dollars as the currency on the navigation bar. If the Website displays an estimated conversion into another currency, the final amount charged, the card issuer’s exchange rate and any foreign-transaction fee may differ.

Delivery charges and any other order-specific fees will be shown before payment or, where a manual shipping quotation is required, agreed with you before dispatch.

For international orders, the recipient is responsible for destination-country duties, import taxes, brokerage and customs-clearance charges unless checkout expressly states that they are included. See Shipping and Delivery for more detail.

5. Placing an order and forming the contract

Please check your basket, personal details, delivery address and selected options before submitting an order.

An automatic order acknowledgement confirms that we have received your order; it does not necessarily mean that we have accepted it. A contract is formed when we send a dispatch confirmation, a collection-ready message, or another clear written acceptance. If payment is taken before acceptance and we cannot accept the order, we will refund the amount paid for the affected item or order.

We may decline or cancel an order before acceptance where an item is unavailable, a price or description contains an obvious error, payment is not authorized or received, delivery is not available to the address supplied, or we reasonably suspect fraud or misuse. If we cancel after taking payment, we will issue a refund for the cancelled item or order.

Your order confirmation and these policies are intended to provide a record of the transaction that you can retain. Please keep your confirmation email and proof of payment.

6. Payment

Available payment methods are shown at checkout or agreed with you for a manually quoted order. Payment is subject to authorisation by the relevant payment provider. You confirm that you are authorised to use the selected payment method and that the billing information you provide is correct.

Payment-card details are processed by the selected payment provider. We do not intend to receive or retain your full card number. The Privacy Policy explains how order and payment-related information is handled.

7. Made-to-order, personalised and custom work

A product page or quotation will identify any item that is made to order, personalised or produced to your specifications. Production begins only after any required details and payment have been received.

Personalised items and goods produced to your specifications, including custom-sized fine-art prints, may not be cancelled or returned for change of mind once production has begun. This does not affect your rights if the item is faulty, damaged, misdescribed or supplied incorrectly.

Custom orders, wholesale orders, image licensing, commissioned photography and bespoke fine-art quotations may be governed by separate written terms. If those terms conflict with these Website Terms, the separate terms will apply to that transaction.

8. Delivery and studio collection

We dispatch from Diego Martin, Trinidad and Tobago, and offer domestic and international delivery to available destinations. Delivery dates are estimates unless we expressly agree a guaranteed service in writing. Full details appear in Shipping and Delivery.

Studio collection is by prior arrangement only. An order is ready for collection only after we send a collection-ready message. Please bring your order confirmation or suitable identification.

9. Cancellations, returns and exchanges

Our Returns and Exchanges Policy explains the product-condition requirements, exclusions, return costs, remedies for faulty or incorrect goods, and refund timing. That policy forms part of these Terms.

Nothing in these Terms or any product description excludes or limits rights that cannot lawfully be excluded, including statutory rights relating to goods that are defective, unsafe, misdescribed or unfit for their stated purpose.

10. Promotions and discount codes

A promotion may have its own eligibility, dates and exclusions. Unless stated otherwise, discount codes cannot be exchanged for cash, combined with another promotion or applied after an order has been submitted. We may withdraw a promotion before an order is accepted, but we will not retrospectively remove a valid discount from an accepted order.

11. Intellectual property

The Website and its contents—including photographs, artwork, surface designs, product designs, text, logos, graphics and layout—are owned by or licensed to Rachel Lee Young and/or Rachel Lee Young (Trinidad) and are protected by applicable intellectual-property laws.

You may view the Website and save or print reasonable extracts for personal, non-commercial reference. You may not reproduce, modify, publish, sell, license, distribute, scrape, train a model on, create derivative works from, or otherwise exploit Website content without prior written permission.

Buying a physical product or fine-art print does not transfer copyright or any commercial reproduction right in the image or design. Please contact us about image licensing or another authorised use.

12. Reviews, photographs and other submissions

If you send us a review, testimonial, photograph or other content for possible publication, you confirm that it is yours to share and does not infringe another person’s rights. We will seek or rely on your permission before using identifiable customer content in marketing, and you may withdraw future permission by contacting us. Withdrawal will not require us to recall material already lawfully printed or distributed.

13. Acceptable use of the Website

You must not use the Website unlawfully; attempt to gain unauthorised access; introduce malware; interfere with the Website or another user; harvest personal information; submit fraudulent orders; or use automated systems in a way that places an unreasonable load on the Website.

14. Third-party services and links

The Website may link to or use third-party services, including service providers, payment providers, delivery providers and social-media platforms. Their services and privacy practices are governed by their own terms. A link does not mean that we control or endorse every aspect of the third-party service.

15. Website availability and corrections

We may update, suspend or withdraw parts of the Website for maintenance, security, stock changes or business reasons. We do not promise uninterrupted or error-free access, but we will take reasonable steps to correct material errors brought to our attention.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence, and nothing limits a consumer’s non-excludable statutory rights.

To the fullest extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable when the contract was formed, or for business losses arising from a consumer purchase. If you purchase for business use, separate commercial terms may apply.

We are not responsible for loss caused by incorrect information supplied by you, your failure to follow product-care instructions, normal wear and tear, misuse, or an event outside our reasonable control.

17. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, flooding, fire, industrial action, transport disruption, carrier or customs delay, utility or internet failure, epidemic, governmental action or civil disturbance. We will contact you where reasonably possible and take reasonable steps to reduce the effect of the delay.

18. Governing law and resolving concerns

These Terms are governed by the laws of the Republic of Trinidad and Tobago. The courts of Trinidad and Tobago will have jurisdiction, subject to any mandatory consumer right you may have to bring a claim in another jurisdiction.

Please contact us first so that we can try to resolve a concern promptly. Consumers in Trinidad and Tobago may also seek guidance or redress through the Consumer Affairs Division or another competent authority. Mandatory rights in the customer’s country of residence are not displaced where the law does not permit that result.

19. Changes, severability and waiver

We may update these Terms from time to time. The version in force when we accept your order will apply to that purchase unless a change is required by law or agreed with you. If one provision is found invalid or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver of that right.

20. Contact

Questions about these Terms may be sent to rachel@landofthehummingbird.com or by WhatsApp or telephone at +1 868 682 4063. We aim to reply within two business days.
